Standardized forms are an essential part of Texas real estate. But do you know the difference between Texas Real Estate Commission forms and Texas REALTORS® forms?
TREC Forms
The Texas Real Estate Commission makes its contract forms available to everyone—you don’t even have to have a real estate license to use them. However, TREC intends for these forms to be used primarily by license holders and advises anyone else to contact a licensed real estate professional or attorney for assistance. TREC rules require license holders to use these forms subject to several exceptions.
Texas REALTORS® Forms
Only members of Texas REALTORS® with active TREC licenses can use the more than 130 additional forms provided by Texas REALTORS®. These forms are not mandatory and are for the members’ benefit.
Association members can access TREC and Texas REALTORS® forms on the Blank Forms page of 3588612.com and from the following form-fill and transaction management vendors: zipForm, Brokermint, Jointly, DocuSign, Dotloop, Instanet, Flow ROI, and SkySlope. Certain disclosure forms are also available through Sellers Shield, a Texas REALTORS® risk management partner.

Please clarify. If TREC provides the form we should use it in place of the TXR form?
If a TREC from is in the TXR library it is their for convience and there is no difference in the form. You will not find a TXR from in the TREC library.
I’m not sure when the real estate commission decided to allow non realtors to use their forms. To me, you are requiring Realtors to have a license and giving away and aiding non licensed buyers and sellers to use the same forms. Seems to me that you are supporting “for sale by owners “ to continue to show a disregard for the education and training that realtors have to go through to do our jobs. TREC forms are available to the public because they are considered public records.
Isn’t the “One to Four…” The exact same form?
Yes. TXR has taken all the TREC forms and included them in their library as a convience to its members. We simply go to one library and have access to TREC and TXR froms in one place.
Can a non-Realtor (i.e. a tenant, lawyer, individual property owner, etc.) make changes (ex: cross outs) to the Texas Association of Realtors Residential Lease form without the assistance of a Realtor, or would doing so allow for another party to argue the form as been invalidated because a Realtor was not involved?
